We examined Confucian moral philosophy, primarily the Analects, to determine how Confucian ethics could help managers regulate their own behavior (self-regulation) to maintain an ethical standard of practice. We found that some Confucian virtues relevant to self-regulation are common to Western concepts of management ethics such as benevolence, righteousness, wisdom, and trustworthiness. Some are relatively unique, such as ritual propriety and filial piety. We identify seven Confucian principles and discuss how they apply to achieving ethical self-regulation in management. In addition, (...) we examined some of the unique Confucian practices to achieve self-regulation including ritual and music. We balanced the framework by exploring the potential problems in applying Confucian principles to develop ethical self-regulation including whistle blowing. Confucian moral philosophy offers an indigenous Chinese theoretical framework for developing ethical self-regulation in managers. This is relevant for managers and those who relate to managers in Confucian-oriented societies, such as China, Korea, Japan, and Singapore. We recommend further research to examine if the application of the Confucian practices outlined here actually work in regulating the ethical behavior of managers in modern organizations. (shrink)

ABSTRACT This essay tells the story of Perelman and Olbrechts-Tyteca's “dissociation of concepts,” which they introduced in 1958 and is in use as a tool of criticism by many rhetorical critics. The story begins in England with John Locke's development of associative reasoning in 1770 and then moves to France, with Remy de Gourmont extending associative reasoning with the concept of dissociation in 1899. Gourmont's dissociation crosses the Atlantic and is then developed by Kenneth Burke in 1931. In turn, Perelman (...) and Olbrechts-Tyteca absorbed and expanded Locke, Gourmont, and Burke's theories of association and dissociation in 1958. They crafted a tool, the dissociation of concepts, that equips rhetorical reasoning with the capacity to navigate between the promise and perils of fission and fusion. Since 1958, many scholars have made productive use of Perelman and Olbrechts-Tyteca's innovation. The essay concludes with some possible futures for their dissociation of concepts. (shrink)

The Israeli approach to advertising consists of two complementary sets of norms, legal norms and moral‐ethical norms. Advertising legislation demands honest disclosure. The Israeli legislator refrains from intervening in fundamental rights such as freedom of expression, free trade, occupation, and liberty of contract in advertising. However, there are also few interventions to prevent phenomena that are dangerous or abusive, especially to groups needing protection. The Israeli courts do try to apply moral considerations in cases tried by them, but living up (...) to moral responsibilities is different from complying with legal obligations. Advertisers in Israel have a(i) Treatise(r), consisting of ten ethical guidelines, which neither sums up advertising ethics in its entirety nor is legally binding. Sociological and psychological features of the culture need to be examined in order to spell out what truth and honesty in advertising actually mean in this society, and the manner in which these values are practised. Lacking sanctions in public law against misleading consumers or manipulation based on false facts, consumers must find remedy in civil actions which rely on moral and ethical rules. (shrink)

This paper returns to the juncture of race, culture, and aesthetics in the context of visual-arts education, especially regarding the failure of higher art discourse to be inclusive and comprehensive of others. Though pedagogical curricula in the United States require that K–12 art teachers be trained to promote multiculturalism in their discipline, their training is affected by art history and studio teaching in which Eurocentrism generally persists. Instructors in studio and art history programs seldom identify as "art educators," most likely (...) because art education is regarded as a hybrid, impure discipline. In the twenty-first century, the debate about life on other worlds is quickly changing from the realm of speculation to the domain of hard science. Within a few years, as a consequence of the rapid discovery by astronomers of planets around other stars, astronomers very likely will have discovered clear evidence of life beyond the Earth. In this short article, we articulate a position that organ recovery from uncontrolled DCD — primarily patients who have suffered a cardiac arrest — is unlikely to result in a significant number of organs, and this small gain must be balanced against significant risk of unduly influencing resuscitation provider decision-making, and jeopardizing public trust in the propriety of organ donation and transplantation.

Research has suggested an increase in loneliness during the COVID-19 pandemic, but much of this work has been cross-sectional, making causal inferences difficult. In the present research, we employed a longitudinal design to identify loneliness trajectories within a period of twelve months during the COVID-19 pandemic in Belgium (N = 2106). We were particularly interested in the potential protective role of self-compassion in these temporal dynamics. Using a group-based trajectory modelling approach, we identified trajectory groups of individuals following low (11.0%), (...) moderate-low (22.4%), moderate (25.7%), moderate-high (31.3%), and high (9.6%) levels of loneliness. Findings indicated that younger people, women, and individuals with poor quality relationships, high levels of health anxiety, and stress related to COVID-19, all had a higher probability of belonging to the highest loneliness trajectory groups. Importantly, we also found that people high in two of the three facets of self-compassion (self-kindness and common humanity) had a lower probability of belonging to the highest loneliness trajectory groups. Ultimately, we demonstrated that trajectory groups reflecting higher levels of loneliness were associated with lower life satisfaction and greater depressive symptoms. We discuss the possibility that increasing self-compassion may be used to promote better mental health in similarly challenging situations. (shrink)

Legal theorists are familiar with John Finnis's book Natural Law and Natural Rights, but usually overlook his interventions in US constitutional debates and his membership of a group of conservative Catholic thinkers, the 'new natural lawyers', led by theologian Germain Grisez. In fact, Finnis has repeatedly advocated conservative positions concerning lesbian and gay rights, contraception and abortion, and his substantive moral theory derives from Grisez. Bamforth and Richards provide a detailed explanation of the work of the new natural lawyers within (...) and outside the Catholic Church - the first truly comprehensive explanation available to legal theorists - and criticize Grisez's and Finnis's arguments concerning sexuality and gender. New natural law is, they argue, a theology rather than a secular theory, and one which is unappealing in a modern constitutional democracy. Through an analysis of mobilization among childcare workers, we argue that care workers can address redistribution and recognition simultaneously through vocabularies of both skill and virtue. We conclude with a discussion of strategies to overcome the false dichotomy between recognition and redistribution.

Instead of following the traditional route of looking for general conditions that apply to collaborative practice, phenomenology turns to what actually happens in collaborative experience and shows that success is (...) not just a function of applied procedures, even when they are in play. Instead, individual experts seem to rediscover their ability to keep their thoughts and concepts looser, more informal, and open-endedly responsive to the situation—just as they did when they first began to shape unfamiliar circumstances into a regionally shared practice—only now with potentially interdisciplinary circumstances as their experienced phenomenon. By cultivating an awareness of how it is with life prior to its being variously studied, exploited, or harnessed to explanatory theories and essentialist ideas, they remain open to becoming expert collaborators, just as they are already regional experts. Among the most enduring taboos, those related to the human body are the most enduring, throughout history. Be it its re/presentation of exploration, it constituted for most cultures and epochs a very sensitive subject, ever evolving and changing, but perennially raw and open to debate and discussion. With the advent of new technologies sustaining and infiltrating society, the body is seen, explored and represented in new ways that can be, simultaneously, interpreted either as transgressive or respectful of taboos, depending on (...) the point of view or the current social norms. The question is: are we able to transcend transgression of taboos through our work or are we still far from achieving it? Our tools are computer-generated simulations based on patient-collected data. Building our arguments on Foucault’s Birth of the Clinic (1973) analysis, we approach the evolution of our own research as a ‘case study’. In the age of the life-support, stem-cell therapy and 3D organ printing, is computer simulation mimicking or mirroring organic life and phenomena, or is it creating a debatable simulacrum? From reducing the human body to a series of equations that lead to depersonalization and loss of self, to tailored modelling based on patient-collected biological data, the computer simulations took a variety of guises. At each point of the way, confronting the taboos, conventions and through controlled transgressions of established rules, we strived to transcend all historic limitations and update, adjust and fine-tune the technology and its uses to better suit the clinicians’ pursuits. The assumptions that literary criticism and philosophy are closely linked—and that both disciplines can learn much from each other—lead David White to examine key passages in James Joyce’s novels both as a philosopher and as literary critic. In so doing, he develops a thesis that Joyce’s attempt to capture the mysterious process whereby perception and consciousness are translated into language entails a fundamental challenge to everyday notions of reality. Joyce’s stylistic brilliance and virtuosity, his destruction of normal syntax and (...) meaning, “shock one into a new reality.” In the book’s final section, White examines the subtle relation between literary language and human consciousness and traces parallels between Joyce’s stylistic experimentation and Wittgenstein’s and Husserl’s ideas about language. Poverty, inequality, violence, environmental degradation, and tyranny continue to afflict the world. Ethics of Global Development offers a moral reflection on the ends and means of local, national, and global efforts to overcome these five scourges. After emphasizing the role of ethics in development studies, policy-making, and practice, David A. Crocker analyzes and evaluates Amartya Sen's philosophy of development in relation to alternative ethical outlooks. He argues that Sen's turn to robust ideals of human agency and democracy improves on (...) both Sen's earlier emphasis on 'capabilities and functionings' and Martha Nussbaum's version of the capability orientation. This agency-focused capability approach is then extended and strengthened by applying it to the challenges of consumerism and hunger, the development responsibilities of affluent individuals and nations, and the dilemmas of globalization. Towards the end of Way to Wisdom , after noting how specialization has fragmented modern thought, Karl Jaspers writes that One might wish for a philosophy that would encompass and assimilate the whole tradition, that would be equal to the intellectual situation of our time, that would express the contents common to all of us, and this both in sublime intellectual constructions and in simple propositions capable of finding resonance in every man.

Although the basic ideas of the ontological argument can be found in Aristotle and Philo Judaeus, the argument received its classical formulation in Anselm's Proslogion and his Reply to the objections raised by Gaunilo. During the succeeding nine centuries the argument has had a chequered career. It was supported by some scholastic theologians but rejected by Aquinas. Descartes and Leibniz offered their own versions of the proof but Kant's refutation of the argument has generally been accepted as conclusive during the (...) past century and a half. Nevertheless, interest in the proof has never completely disappeared—perhaps provoked by Aquinas' suggestion that the proof may be valid for God even though it cannot be valid for us because of the inadequacy of our knowledge of God. Recently there has been a revival of interest in the ontological argument. J. N. Findlay put the argument into reverse to show the necessary non-existence of God in an article in 1948 but in later writings he has suggested that the argument may have positive significance. In 1960 Norman Malcolm published a paper in which he distinguished two basically different forms of the ontological argument in the Proslogion and defended the possible validity of the second of them. An exploratory model is presented as a heuristic to indicate how individual perceptions of corporate reputation (before joining) and corporate ethical values (after joining) generate specific individual organizational senses of fit. The paper suggests that an ethical dimension of person-organization fit may go some way in explaining superior acquisition and retention of staff by those who are attracted to specific organizations by levels of corporate social performance consonant with their ethical expectations, or who remain with them by virtue of better (...) personal ethical fits with extant organizational ethical values. Specifically, the model suggests that individual misfits that arise from ethical expectations that either exceed or fall short of perceived organizational ethical performances lead to problematic acquisition and retention behavioural outcomes.
